Terms of Use

Prime Performance RMS (the “Application”), available at rms.robtracz.com, is a relationship management and financial tracking tool operated by Rob Tracz (the “Operator”) for his personal and business use. Access is restricted to the Operator and authorized agents acting on his behalf. No other party has the right to access, copy, modify, distribute, or otherwise use the Application without prior written permission from the Operator.

Where access has been authorized, the user agrees to use the Application only for lawful purposes and in compliance with the terms of all third-party services integrated by the Application (including but not limited to Intuit QuickBooks Online, Anthropic, OpenAI, Resend, Google Workspace, Fathom, and ClickUp).

The Application integrates with multiple third-party services. Each integration is subject to that provider's own terms and privacy policies. The Operator is not responsible for the availability, accuracy, or behavior of those external services.

The Application is provided “as is” and “as available” without warranty of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy of data, uninterrupted availability, or non-infringement.

To the fullest extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to use of, or inability to use, the Application.

The Application stores business and contact data necessary for its operation. See the Privacy Policy for details on what is collected, how it is stored, and which third-party processors receive it.

The Operator may revise these Terms at any time. Material changes will be reflected in the “Last updated” date above. Continued use of the Application after revisions constitutes acceptance.

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of- law principles.
